Gerry and Kate woke at 7.30 - 8.00am, washed the children and had breakfast between 8.00 and 8.30.  The food had been previously bought by them both at Baptiste supermarket.

During breakfast, Madeleine asked Kate why she had not gone into her room when the twins were crying,(Kate told Fiona that Madeleine asked her why when Madeleine and Sean were crying) 
however, Gerry claims Madeleine asked HIM why he hadnt gone in when the twins were crying (but 6 days later he changed it to Madeleine asking Kate why she didnt go in when Madeleine and Sean were crying )- 

During breakfast. "She noticed a stain, supposedly of tea, on Madeleine’s pijama top, which she washed a little later that same morning. She hung it to dry on a small stand, and it was dry by the afternoon. Madeleine sometimes drank tea; the stain did not appear during breakfast, maybe it happened another day, as Madeleine did not have tea the previous night and the stain was dry."

According to Kate, "After breakfast they got dressed and left the apartment by the main door
. All children went walking. The verandah door was closed and locked; she doesn’t know whether the main door was locked or unlocked."

Gerry describes differently, "after breakfast, about 09h00, KATE and the children left by the rear door, he having left by the front door, which he locked with the key, having also closed and locked the rear door from the inside."

Matthew, Rachael and G***e  went to the Millennium Restaurant for breakfast, as they did each morning.  There wasn’t anybody else there, they had breakfast on their own. There were people at the other tables but it was fairly quiet, and none of the other group were there initially. They were always fairly early because G***e was always awake earliest, always by half six or six o’clock and she’d be sort of sparky and awake and wanting to get up and so they'd sort of trudge on and they might even be banging on the doors waiting for them to open up, they'd be fairly early to breakfast.

Rachael, however said they were all (except the McCanns who had their breakfast in the apartment)  at breakfast. (maybe she forgot that Dianne didn't go to breakfast when she had tennis).  

Jane Tanner was up late and didn't go to breakfast but Russell took E**a and E**e and met Matthew Oldfield as he was leaving.  

Matthew didn't want to take G***e to the Nursery as she was a bit upset so Rachael volunteered to do it.

Rachael also claimed that Madeleine and the twins went to the club that morning.

After dropping G***e off at the club, Rachael returned to their apartment to get ready for tennis.

Russell, E**e, E**a and Matthew went back in to the Millenium.


After breakfast, Kate and Gerry took the twins to the creche, although there is no record on the creche records of the twins being there that morning, and Kate presumed that Gerry took Madeleine to the creche.

"Gerry said They made their way on foot by the usual route to the crèche next to the TAPAS where they left the twins, and, while KATE stayed to play tennis he took MADELEINE to her crèche, through the short-cut, where they arrived at 09h15, and , since it was obligatory, he signed the child's attendance register. 

The records show that Gerry dropped Madeleine off at 9.10 and Catriona Baker recalls seeing him around 9.15.

Once the children had been delivered, they went to the tennis courts for a scheduled tennis lesson. Kate’s group lesson was at 9:15, Gerry’s an hour later. Kate didn't know what Gerry did during that free hour; she presumes he went to the apartment.

On returning, not by the short-cut, Gerry went to the supermarket where he bought milk, he presumes, making his way to his apartment, entering by the front door, that was locked by key, when it was 09H40/09H45.

He remained at home for about 15 minutes, dressing in tennis clothes, left by the front door, that he did not lock, and made his way to the tennis courts by the usual route, they being next to the TAPAS.

Kate met Rachael, Jane and Dianne at the courts at 9.10am

Rachael claimed that Russel went to the beach with Matthew and Fiona and Dave were also down there, David says they took the dinghys out, but Matthew claimed that  when the left the Millenium, Russell went on and he turned left and went down to the beach and went sailing for that morning.

Meanwhile  as Russell's daughter E**e was feeling ill, he dropped E**a (his other daughter!) at the Kids Club at around 10am (9.50 according to records) after breakfast. 
He completely corroborates his partner Jane Tanner's statements for the rest of the day.

ROB Went to the flat with E**e whiles she was resting he went outside to watch Jane play tennis. He went to the flat with E**e he thinks she had a snooze that morning,  and he read a book and played with her and then, at some stage,  when Jane had finished playing tennis, he then went out with E** play tennis.

According to Gerry, when Kate had finished playing tennis  at 10:15, she went to the recreation area next to the swimming pool to talk to Russell until Gerry’s lesson was over.
 

Jez arrived for tennis with Gerry and noted that the two females of his group (Rachael and Jane?) were not there,  (where were they?)  just one that he did not know the name of (Dianne?).

He had met Rachael and Jane (and Mathew an Russell) on the plane.

On the second court between 9 and 10 another person REAP was playing.

While Gerry and Jez were playing, at 10.30 there was the Minis for tennis.  This was not Madeleine's group. It was the group with Bridget O'Donnell and Jez Wilkins' girl that was playing.

Bridget claimed all the girls were pink and pretty.


At the same time (10.30am) Madeleine was being taken on the speedboat by Catriona and telling her she was scared.

Catriona recalls seeing friends of Kate and Gerrys David and Jane (meaning Fiona?)

Russell remembers that  after Jane’s tennis lesson   ‘ one of the guests ,a  man from Southampton came up , ‘ his three year old daughter, was having a kid’s tennis lesson.

He felt it was important, particularly, because of what the man said, if Madeleine was potentially being photographed by anyone, it was absolutely clear that Madeleine and E**a were not there that day.

And present at that conversation were Russell, Jane, Kate and Rachael, 

There were a couple of people who were, who Kate and Rachael and Jane had played with, I, I forget the names. I’ve got this vague recollection there was a lady who, probably in her mid-forties, blonde hair, who may have been there as well, (Anne & Jayne Jensen? - they were booked for 12.1- 2.30)

At 10.52 Russell's mobile was active for the only time that day.

Just before 11.00am, Kate was still there (we don't know the time that morning that she washed the tea stain!), Rachael and Jane  also, as Russell confirmed they were there during the children's tennis and the conversation with the man from Southampton.

Fiona and Dave were on their way back to their apartment (where they arrived at 11.30am) as they were cold from sailing.

Russell, Jane and Evie walked down to the beach just after 11.00 as they met Fiona and Dave on their way back.

They met Dave and Fi coming back, because they’d had their second, sailing lesson they said‘Oh we’ve seen Madeleine and Ella on a boat down there’ So then Jane and Russell went down to the beach,  and Russell took out a kayak and Jane sat and just played

Ella and Madeleine and 
the rest of the group were getting ready to walk back up to the Kids Club

Jane  got pictures of Ella, of Evie, (Note: Not Madeleine in the same group?) that’s about the first day she took pictures 
Thursday was  probably one of the first nice days the sun had  come out in the day.

They didn’t know where Kate went at that point, but she didn’t co to the beach with them.


Matthew Oldfield was booked for 11.00 (He and Rachael had said he went down to the beach for sailing around an hour earlier at 10.00am!)

Records show that he played with Dan on Court 1 while FOSTER played on court 2.

After Gerry's tennis class finished at 11.15, he stayed in the pool area talking with his wife andother persons, whom he does not remember.

After tennis, they all went to the pool. Jez saw Gerry and Kate near the pool relaxing and spent the majority of the time talking with the tennis coach She was a British tennis instructor whose name is George or Georgina. He remembered that she was telling them a bit about her personal life.

 The coach appeared to be talking about her life in general and both Jeremy and Bridget noticed that Gerry and Kate were listening intently to her. Jeremy thought this to be courteous of them considering they did not know her.


Fiona and Dave were drenched and really wet and really cold, so they came back to the apartment to get,  more clothes because they hadn’t taken enough with them.  Eleven, half eleven, that they  were back at the apartment.

And then they sat, by the pool for a bit with Dave and then we saw Kate and Gerry and we justsat and had a chat with them

At some point Kate and Gerry went back together to the apartment until close to 12:15 whenKate went to Madeleine’s creche to pick her up, together with Fiona Payne. 
She signed the register  (but CAT does not recall seeing her) and went to the twins’ creche with the intention of picking them up, she thought she would meet Gerry there, not knowing if he already had the twins with him

The twins were not signed in or out that morning.


Together with the three children they went to the apartment for lunch, with food bought at the supermarket. This would be around 12:35/12:40. They ate sandwiches, mainly she and Gerry, and the children maybe ate pasta. Lunch lasted around 20 minutes

Gerry claims that at 12H00, together with KATE,  she made lunch and he went to get MADELEINE. He thinks that it was KATE who took the twins home. Since it was he who went to collect MADELEINE, he is sure he used the short-cut.

, the meal having lasted an hour until 13h30

At that time the Last Picture was taken!!

Fiona and Dave and Dianne had lunch in their apartment and (unusually) Jane and Russel, Matthew and Rachael had lunch together.


NOTE:

Remembering these timelines are taken from T7 (contrived) statements.

Jez (credible witness) did not see Jane and Rachael OR (maybe) Kate when he arrived even though they all claim to have been there.

ROB claims they were there and entered into a conversation with the Man from Southampton.

Rachael and Matthew claim he was sailing in the morning...going at around 10.00am but he was booked for a tennis lesson at 11.00am

Kate claims to have chatted with ROB after her lesson but he says he was in the apartment looking after E**e for some time.

Fiona claims to have seen Kate and Gerry by the pool for 10 minutes before they went to pick up Madeleine and Scarlett but Kate and Gerry say they were back in the apartment at that time. (Where did Kate meet up with Fiona to collect the children?)

Many more discrepancies for that morning nd I haven't finished putting all the statements together.

Jane, Rachael, Fiona, Matthew and Russell were not mentioned by Jez, even though he knew some of them from the plane and they claim to have been there!

KATE During breakfast the “crying episode”, already described, took place. She noticed a stain, supposedly of tea, on Madeleine’s pijama top, which she washed a little later that same morning.    MO - The Thursday morning we, Rachael, G***e and I went to the Millennium Restaurant for breakfast, well as we did each morning, as I’ve already said. There wasn’t anybody else there, we had breakfast on our own. I don’t mean there was nobody else at any other table, but it was fairly quiet, but none of the other group were there initially. Now we were always fairly early because G***e was always awake earliest, erm, awake at, I don’t know”.

 MO - I didn’t really enjoy dropping G***e off at Nursery because she got a bit upset, Rachael volunteered to go and do it. So she went back, erm, she went back first and I stayed with Russell and went back in for breakfast, because I was going to go down to the beach and sail because they had, erm, either a sailing or a wind surfing, I think they had sailing that morning, so I was going to go down and go sailing, that’s what we’d agreed that I would do. Erm, so we went back in and he had breakfast and I think Jane had tennis, I think maybe they were, I think they had a lesson, did they have a lesson together Rachael and Jane, erm, they wouldn’t have done because we’d have had lessons as a couple. And so I went back in with Russell and E**a and E**e and we had breakfast and then we walked back together and we, Russell had to take E**a and E**e, erm, so he dropped E**a off at the, at her Nursery area which was separate from where we drop G***e, 


 Afterwards the witness took G***e to the Club.Madeleine and the twins also went to the Club that morning, (?) as well as the other children in the group.

The witness, after leaving G***e at the club went to the apartment to get ready for tennis. Also present at the tennis courts between 9.10 and 10.10 were Kate McCann, Dianne Webster and Jane Tanner.

He went to play tennis at 1030hrs and noticed Gerry was there. He engaged in general conversation with him as well as a female member of Gerry’s group, but he could not name her.

  The witness’s tennis session was at 11 with Matthew after he returned from the beach. JEZ Relative to the encounter with Gerry and Kate on the 3rd of May 2007;
I had a tennis lesson with Gerry from 10h00 to 11h00. After the lesson we went to fetch the children from the crèche. I saw Gerry and Kate near the pool relaxing. I remember that they were talking to a British tennis instructor whose name is George or Georgina. I remember that she was telling them a bit about her personal life.

JEZ - 3 May 2007.

He went to play tennis at 1030hrs and noticed Gerry was there. He engaged in general conversation with him as well as a female member of Gerry’s group, but he could not name her. After which they all went to the pool. Both Gerry and Kate were present this time and spent the majority of the time talking with the tennis coach. The coach appeared to be talking about her life in general and both Jeremy and Bridget noticed that Gerry and Kate were listening intently to her.  FP - And then it was time to pick up the kids, so Kate and I walked from the Tapas area over to the main reception, going between, you know, there was a sort of path that went between the other Ocean Club complex as well along the road, erm, and she picked up Madeleine and I picked up Scarlet and then we walked back together and that was the only day we ever did, ever did that. Erm, 

and then when we got back they, you know, Kate too Madeleine to their apartment for lunch and, erm, I went up to ours for lunch. 

And that day, erm, I think was the only day that no-one else came for lunch, erm, tut, I think that was just me, Dave and my mum, and the others,

Rachael and Matt, I think, had their lunch with Russ and Jane, erm, so those two families were together, 

Kate and Gerry on their own and us on our own.


DP - on that particular day err me and Fiona had you know gone down to the beach, we err took the dinghies out err as usual we went, you know we had the kids, err we had lunch err in the apartment.

 RRY 13h30 After that time they made their way to the resort play area, the deponent left by the front door and the rest of the family by the rear door that, once again, he shut and locked from the inside. As to the front door, he does not know exactly if he locked it.

After finishing lunch they stayed for a while at the apartment, then they went to the recreation area next to the pool, as the children were somewhat restless, maybe tired or bored. They remained at this area an hour, maybe more, then they left the twins at the creche next to the Tapas and both of them took Madeleine to the other creche. They went via a path in front of the small reception and then through gardens and stairs, taking a short cut. This route was the one mentioned by Gerry.

 We put our kids to bed slightly earlier that day, thinking, because it was a nicer day, that we’ll try and get down to the beach and, you know, have a bit of a afternoon at the beach with them. So that day was slightly different”.

remember Madeleine shouting things to us on the tennis court, you know, and I can

After 17H30 they went to the apartment, the deponent having entered by the main door, which he did not lock while he was inside the residence. KATE and the children entered by the back door, after this had been opened from the inside by the deponent.

 Gerry continued playing tennis with a guest called JULIAN who belonged to his tennis group, while she went for a jog along the beach, for around half an hour. During that period she saw the rest of the group, children and grownups; she was disappointed as nobody had told her that they were going to the beach and Madeleine surely would have loved to have gone with them. She cannot confirm whether she went to the apartment between the tennis game and the jog.

When she finished jogging, at around 5:20/5:30 p.m., she went to the Tapas area.Gerry was there, as well as the twins and Madeleine who were having dinner at separate tables. Madeleine had been taken to the area by the nannies. Her parents were required to sign the register when the meal was over, at around 5.30 p.m.. During the meal Kate asked Madeleine if she was sad because the other children in the group had gone to the beach without her; she replied that she wasn’t, but was rather tired. She asked Kate to carry her back to the apartment. Kate agreed, and Gerry led the twins back to the apartment, as well. Tiredness was due to the intense daily activities, not to any sickness.

They arrived at the apartment at around 5:40 p.m., earlier than usual, because Madeleine was tired, their other friends were at the beach
 

At the apartment they both bathed the children, and close to 6:00 p.m. Gerry went to the tennis courts, right after the children had finished their bath. They entered the apartment by the main door, with the key. She does not know if it was locked, and presumes it was Gerry who opened it. At lunch time they also entered through the same door.

Gerry claims he was there and Kate claims he was playing with Julian earlier but was already at the tapas when she arrived, so did someone TELL Catriona he was playing tennis?

If not, did she know them well enough to guess (even though he was 'supposedly' right there?)

“Well there was only two courts and during that time, because this was a set, erm, MARK WARNER tennis sort of hour”.


“You couldn’t book the courts for practice, erm, so both courts were, for that hour, the men’s tennis. Erm, so I don’t recall anyone else playing in the, you know, or practising. Erm, I think, you know, I, I, as I recall, I mean, I couldn’t say for sure whether there were other men there, I seem to remember there being a lot of focus on them sort of playing what they wanted to play, the, you know, out of, you know, Russell, Matt and, erm, and Gerry, you know, I’m sure they were practising doing shots and things like that, which is what they wanted to do, so I think if there had been other people there, they would have been having to join in with that. Erm, because I think, I mean, Dave on his camera might even have photos, I think I even took photos, erm, of them practising doing a serve”.

ROB - around the five or five fifteen, five twenty mark or somewhere round there, erm, Kate McCANN came running down, she didn’t, I don’t think she stopped to speak to us, as far as I recall, erm, and she carried on up on the hard sand, quite near to the water, away towards, towards I think what’s called Black Rock
I don’t remember her coming back, but as time went on, I think the kids were getting a little bit hungry, so we drifted back up the beach to the, the Paradiso Restaurant, I think it’s called, erm, and got some chairs there, ordered some, some food for the children, because they’d missed, they’d missed high tea. I have missed something out, something out here, of course, is that, erm, around the five o’clock mark, erm, I had to pelt up to Ocean Club to get El out before the Nannies would have taken them up to high tea back at the Tapas. So I went up there, collected E and brought her back to the beach

They arrived at the apartment at around 5:40 p.m., earlier than usual, because Madeleine was tired, their other friends were at the beach and Gerry had an all-male tennis game at 6:00 p.m. At the apartment they both bathed the children, and close to 6:00 p.m. Gerry went to the tennis courts, right after the children had finished their bath. They entered the apartment by the main door, with the key. She does not know if it was locked, and presumes it was Gerry who opened it. At lunch time they also entered through the same door
KM - When she finished jogging, around 5:20/5:30PM she went to the Tapas area. Gerry was there, as well as the twins and Madeleine who were eating at separate tables. Madeleine had been taken to the Tapas by the nannies. Her parents were required to sign the register when the meal was over. During the meal Kate asked Madeleine if she was sad because the other children in the group had gone to the beach without her: she replied that she wasn’t, but was rather tired. She asked Kate to carry her back to the apartment. Kate agreed, and Gerry led the twins back to the apartment. Tiredness was due to the intense daily activities, not to any sickness.

They arrived at the apartment around 5:40PM, earlier than usual, because Madeleine was tired, their other friends were at the beach and Gerry had an all-male tennis game at 6:00PM. 

FP - somebody, I don’t know which one of the group, did say they’d seen Kate run past”.

GERRY17h00, as usual, MADELEINE arrived accompanied by the teachers and the other children. After her arrival, MADELEJNE ate, [the meal] having ended at 17H30.

After 17H30 they went to the apartment, the deponent having entered by the main door, which he did not lock while he was inside the residence. KATE and the children entered by the rear door, after this had been opened from the inside by the deponent.

KATE Gerry continued playing tennis with a guest called Jxxxxn who belonged to his tennis group, while she went for a jog along the beach, for around half an hour. She saw the others of the group, children and grownups; she was disappointed as nobody had told her they were going to the beach and Madeleine would have loved to have gone with them. She cannot confirm whether she went to the apartment between the tennis game and the jog.

(8) They stayed to talk to them for around 20 to 30 minutes. Gerald McCann behaved normally. The interviewee supposed that Kate was at the apartment (1) putting the children to bed. Around 7pm, they went to their own apartments (1) with the children. The interviewee bathed her two daughters, read them a story to send them to sleep. As **** was unwell and had difficulty going to sleep, she stayed with her father who, meantime, had returned. The interviewee went to dinner at the, "Tapas," restaurant at around 8.30pm.

He clarifies that when they arrived at that meeting GM was already there, with KM and her children watching the match, the rest of the women and children joining them [KM and children] later.

When David returned from the beach he was with Gerry at the tennis courts, and it was Gerry who asked him to help Kate with taking the children to the recreation area, which had been arranged but did not take place. David was at the apartment for around 30 seconds, he didn’t actually enter the flat, he remained at the verandah door. According to her he then left for the tennis courts where Gerry was. The time was around 6:30-6:40PM

Err I, as I say I’m not sure you know what happened to Matt and Russell at that particular moment but I remember then you know I went over to see err Gerry at the err you know tennis courts, just to see you know what was happening, and err decided that we’d, you know I’d come, come back to play tennis and err Gerry had asked me just to pop in and check everything was alright err with Kate or you know again I can’t remember the exact reason whether he was just making sure it was alright that he could stay there and you know more time but you know he’d asked me to pop in. So I walked back err from the tennis courts, err back to err you know Kate and Gerry’s apartment and the time you know looking at, you know we’ve looked obviously at photographs since then and you know the time that we’ve got that I was you know going to Kate’s about six thirty, err and I went into their apartment through the patio doors. The three children were all you know dressed you know in their pyjamas, you know they looked immaculate, you know they were just like angels, they all looked so happy and well looked after and content and I said to Kate, you know it’s a bit early for the you know, for the three of them to be going to bed, she said ah they’ve had such a great time, they’re really tired and you know err so I say, you know I can’t remember exactly what, what you know the night attire, what the children were wearing but white was the predominant err colour, but you know just to reinforce they were just so happy, you know seeing you know obviously Gerry wasn’t there but they were just all, just so at peace and you know they looked like a family who’d had such a fantastic time and err yeah then I left there, went and got my stuff, went back to the tennis courts and then err there was me, Matt and Russell and I think Gerry played a little, for a little while but he decided that he’d, he’d played enough tennis for that day and err was going back and so it left
 with me,
 Russell and err Matt and err Dan who was the, the you know the tennis coach from Mark Warner. Err so we played some tennis and you know we were having a good knock and then it was getting a bit late so err we, you know we left the tennis courts, went back to our respective partners to get ready to go out, you know it was, it was, you know certainly after half past seven that we’d, you know we’d left the courts, perhaps even a bit later than that. Err when I got back err I think because Fiona had done a lot of babysitting and left me playing tennis she said well I’m gonna go for a very quick run so she went for a run on the beach, you know, err got the kids ready, bathed, got them ready for err to go to bed but again you know as we’d got back late err from the tennis courts you know the whole time err for that evening was not, you know later.

- then I remember it getting to tennis time, because it was men’s tennis that night and the men had all rearranged the time to suit us and it was getting towards six o’clock and, you know, they were going to be late, so I remember saying ‘Look, you better go because it’s not fair, you’ve moved the time then you’ll be late’. Erm, so I think that, that was sort of approaching five to six. 

And we were toying with the idea of getting the kids ice creams for pudding and then thought oh we probably don’t have time, but then we decided well, you know, why don’t you go off and go to your tennis and we’ll just give them their ice cream and follow on. 

And so I think they left probably about, you know, that being Matt and Dave and Russell, around five to six, six o’clock time. 

And the, you know, the wives stayed behind with the kids, they had ice cream and then we followed on about ten past six 
and we just walked back up to, to watch them play a bit of tennis and give the kids, you know, a little playtime. Erm, and I don’t think we stayed there that long that night because the kids were pretty, pretty tired. 


I don’t know who was playing who, but there was certainly Gerry, Matt, erm, you know, Russ and Dave,erm, and typically being men, it was all quite competitive and, erm, and far different to the women’s tennis. Erm,

Kate and the kids, I think, as I said earlier, weren’t there and, you know, they, as Gerry said, were just absolutely knackered and Kate was getting them bathed and ready for bed.

it wasn’t a surprise that they weren’t there. Erm, and I know Dave had said to me later, because he, erm, after tennis he’d said he’d checked on Kate and the kids before going to tennis”.

“How did that come into your conversation?”

“Because he was saying how angelic they all looked and he said to Kate when we all sat down at the Tapas table as well and he was sort of joking how they looked like perfect children, because they were all sat there, all clean in their pyjamas, having a story”.

So we finished and set off, probably about twenty past six, sometime around there, because it was after when we’d got them to move, we were already late, so I think if we’d said, if they’d move it to six thirty and we’re setting off at six twenty, I would have been happy that we could have made it there in time, but we’d already gone past the time when I thought we won’t be able to go because we were already so late”.

And Gerry was down playing on a court, I think there was only three of them, I think the, erm, the coach, whose name I can’t remember, the tennis coach, the blonde haired bloke, erm, was playing to make up the numbers. And so we waited and watched for a little while, so we didn’t get on court until, phew, sometime closer to seven

- So where were you going then? Presumably you weren’t going to play tennis were you? When you left the beach, what was…”
Reply "Yeah, oh yes that was always the intention and that’s what Fiona was saying, look if you’re actually gonna do anything tonight you’d better get yourselves up there and it’s getting quite late so that was, you know, that’s the reason we’d all gone ahead because we waited till the children had finished eating and err got in the prams and got up there, you know it takes another five ten minutes on top walking back with them, err then you know we’d have lost the opportunity. Err again, presuming that you know the tennis was usually around six thirty, that if you know, if we’re leaving the restaurant you know, quarter past six or whatever, around that time, that you know if we’d leave it much longer with it taking ten minutes or whatever to walk up just to start the tennis at half six, you know we were already cutting it fine and I think as it transpired we were playing tennis till you know even beyond there, it was quarter to seven, or around then and err you know if we’d have left it much later then we just thought well it’s gonna finish, so.”

Reply "Well I mean coming back from the beach I’d got no equipment to play tennis you know, etcetera, so I had to go back to my room to you know change into stuff appropriate for playing tennis in, and err so he knew that I’d walk up that by and past so he said oh why don’t you err, you know can you just pop in on the way, the way up, so it was on the way back from me picking the stuff up.”

You know I, you know I did know the children very well, we’d all you know, met up many times before err you know I, you know again I’d be playing with Madeleine you know in the, err the play area err you know during that week, you know lifting her up, twizzing her round and everything, I knew her that well, you know, to do that, and as I say err she’d definitely know who I was and certainly, as I say, just to reinforce that she looked very happy.”

Reply "Yeah, I mean it must, I mean it was before, I mean we got back before eight o’ clock err you know so perhaps just before seven, err sorry, err yeah just before seven so it was just before eight o’ clock. As I say when I got back I think I was cutting it fine and Fiona was still keen to go for a run and we started to get everyone ready for bed.”

Reply "Err I, again my recollection is we sat down and I just started talking to him, but I’m not sure whether that is entirely correct, whether he was having a conversation with somebody else before and then you know I just started talking but my recollection we started, you know, not far after we’d sat down we just started talking and you know, and I say we were just saying, you know what we’d both done and what a fantastic day that we’d had err you know and I know beyond the call of this interview but you know I’d had a lot of stress you know with work and over the last few years and you know it’s, it’s you know two, two young children it’s not been a particularly easy time and you know and for me that was the first day in many, many a month that I’d really enjoyed it and then Gerry had reciprocated and said we also had one of the best days that we’d had in many, many a month. You know that is my recollection of the first thing that happened on that table, but just, whether its because it was such a positive conversation that we’d had, which override the fact that there was other things that had happened before I wouldn’t like to say but in my mind that was the first thing that had happened.”
1485 "Yeah. So did you notice that he got up to go and check Madeleine, or to check his children?”

Gerald searched the apartment and stated that the window of the children's bedroom was open and the shutter raised. He checked the shutter before continuing to search outside.

David Payne ran from the McCann's apartment towards the Millennium area. Then he turned in the direction of the church.

Russell O'Brien was in the McCann's apartment for a moment only, rushing out to search the perimeter of the apartment. Then he went to look for Madeleine with Matthew Oldfield. They went in the direction of the beach. He searched the perimeter of the tennis courts and the paths leading to the beach. Russell searched the gardens and all of the surrounding area.

Fiona searched the periphery of the complex ' one search, which she made alone. When she returned she spent the rest of the night with Kate.

It is difficult to confirm where all the elements were in the minutes/ hours after the discovery that Madeleine was missing. It appears that most of the women remained within or near the apartments, Fiona Payne left and searched around the complex, before returning to the McCann's apartment where she stayed with Kate.

The men's movements, however, are more difficult to pinpoint.

Erm, some people went directly into the flat initially, erm, included, including Gerry and, and Kate, others just stayed at the, at the, at the gate, erm, on the road leading down beside the apartment.

Dave, Matt and I think initially at least Gerry,just said ‘Look, let’s just’, erm, ‘let’s just split up and find’, erm, you know, ‘see if we can find her, seeif she’s just wandered out’. So everyone did a little bit of a search just in the, in the immediate area and I went along the passageway which was in front of the patio, the patio entrances of, of the apartments, erm, round, all the way along that initially, I think, and unbeknown to me at this point, because we hadn’t really used this entrance a great deal, certainly not walked to the other end of it, it was actually a dead-end, so I then had a look in the, in the front gardens of, of the apartments on the ground floor that you could see, searched a little bit just in between the two apartments and obviously this was a fairly brief search and rapidly doubled back

 Dave, erm, Matt, Russell and myself split up in four different directions just to do a search

Then he went to look for Madeleine with Matthew Oldfield. They went in the direction of the beach. He searched the perimeter of the tennis courts and the paths leading to the beach. Russell searched the gardens and all of the surrounding area.

ing to meet Jane in her apartment. When they talked Jane told her that when she had gone to check on the children she saw Gerry and Jez talking together as well as a man carrying a child.

After waiting at the restaurant table for five minutes, Dianne Webster went to the McCann's apartment where she entered the children's bedroom and saw Kate with the twins. Kate insisted on the fact that the window and shutterswere open when she saw the children, Dianne went outside to see if she could raise the shutter from the outside and found it to be impossible. Dianne stayed in the McCann's apartment for about 5 minutes and then returned to the restaurant to fetch her bag, the McCann's camera and the baby monitor.

On the way back from the Shopping Centre’, in the next paragraph, I met Dave and he was running down the hill with a, with, you know, sort of panic in his eyes, saying ‘This is really bad, this is bad, they haven’t found her’. There was obviously, a number of minutes had passed by this point, while we were looking individually”.

-don’t know what Matt,  I don’t know what Dave and Russell did at that point. I said ‘I’m going to go up to the’, erm, ‘Kate and Gerry’s apartment’. Gerry had come down at that point.

Erm, tut, I looked, when I went into the room that Madeleine was sleeping in, the room was dark, Madeleine, erm, Madeleine’s bed was sort of folded back, the sheets, quite kind of neatly really, erm, Sean and Amelie were fast asleep in their cots, they didn’t stir, you know, I was opening the cupboards in the room and moving around the room, they didn’t stir at all, which that was, that was odd.

 
I went to the front of the house and I was trying to lift the shutter at the, at the backjust to prove whether, you know, whether it could have been opened and whether Madeleine could have opened it from the inside”.

“I did it from, I’m talking about, so, again, the back or the front,
 
I did it from the back, which is where their balcony was”.
   She then immediately returned to the McCann's apartment. Gerry and Kate were in the apartment as well as Fiona. Fiona asked Dianne to stay with Lily and Scarlet to check that they were ok. Dianne returned to the Payne apartment and stayed there for the rest of the nigh

Afterwards(ROB) he searched the adjacent apartments to the east of Kate and Gerry along the Rua da Ramalhete and more apartments to the east. On some occasions David Payne was with him.

Matthew spent most of the night searching the neighbouring areas for Madeleine without success. Matthew searched the road between the apartment and the Creche. He searched between the apartment and the Millennium restaurant, also along the beach and finally a cemetery as well as the road leading back to the apartment. Part of this search was carried out with David Payne and Russell O'Brien and part was carried out alone. Matthew talked to an Indian insurance salesman and saw Nathan, the director of the beach concession.

 I found there that you could, if looking back, you, it wasn’t perfect, but you could see a fair amount of the beach and as well, and also be able to look at the waterline as well. Erm, went along there for a bit towards Black Rock, erm, and then, and then at some point decided to turn, to turn back

I probably went round to Jane before I’d done this, this sort of leg to the beach and back, but it may have been, it may have been that I actually went round at this point.

Jane was stood in the doorway, I think almost certainly with Rachael, possibly with Fiona as well. Erm, and, you know, I went up and she was, you know, clearly very, very distressed,

"About 23:00 that night I received a very embarrassed call from my wife's mother who told me about Madeleine's disappearance. Aunt Nora, from Canada, was in Skipton and was about to return to Canada the next morning. I suggested I drive Nora back to Liverpool. We all thought that Madeleine was going to appear in the following hours, therefore I drove Nora back to Liverpool in the early morning of Friday, 4 May. I stayed in Liverpool.I spoke to Kate by phone between 10:00 and 11:00am that morningand she confirmed that she wanted her mother, her father and Nora with her."

Emma Knights (client support director) searched the beach area and asked Kate what Madeleine had been wearing. Shortly afterwards Emma returned to the McCann's apartment and stayed with Kate.

Gerald was seen and spoken to by Neil Berry and Raj Malu. They heard him calling for Madeleine when they were sitting on Neil's balcony, not far from the McCann's apartment. They both went down to talk to Gerald and helped in the search.

Both David Payne and Matthew Oldfield were seen by Emma Knights when she was on her way to the beach, the search area to which she was assigned by Lyndsey Johnson (child care director and search coordinator).

I’ll just say that. I think then we decided that we just needed to look a little bit further afield, erm, and I went round the, the front of the apartments, the high side of the apartments, had a look along there, erm, got to the, what I’m calling the main road that drops in from, erm, from the, from the motor, from the dual carriageway outside of town, and then looked, you know, down, you know, looked down the hill there, erm, towards the, the, erm, the western side of the tennis courts, erm, really looking, you know, either side of the road just to see if she was sort of wandering there, erm, and you could hear kind of ‘Madeleine’ being shouted pretty much everywhere around at this point. Erm, that, the next, after I kind of moved down a bit to the left, there was the Supermarket quite some distance away, but there’s a, there’s a, there’s a road and I think it had a car park or a, well certainly a car park but there was an area of sort of rough that you could probably, you know, it’s not tarmaced or anything, had a look around there, couldn’t see her. And then there’s, erm, there was an entrance into, erm, the building kind of opposite this, which is, is, which is like a Shopping Centre, erm, or at least the lower floors seemed to have a kind of a set of like a Curry House and a Bar and a few things and a swimming pool as well, and, huh, I can’t remember the layout in there very much, but I remember it being kind of split on, on at least sort of two levels, lots of little recesses around kind of, I think kind of shop windows and stuff. So I didn’t really know where I was going, I’d never been in it before, but, nonetheless, sort of wandered around the lower floor and didn’t find anything. I went up on, on, I think on the next floor up, as I came off the stairs and came round there was a, a small Coffee Bar or a Bar on the left and looked in there and asked, there was a, there was a, a man and a, erm, erm, presumably a barman in there, just, there was only a couple of people, and said, you know, ‘Have you seen a little girl’ and, I mean, I don’t know how much English they spoke, but they seemed to, they just sort of shrugged and said no. So then just around that area. And then, and then found my way out of the, the Shopping Centre and actually came out at the other end from where, well a different entrance, I didn’t come out the same way I don’t think, erm, and, erm, it was actually on the road that comes down in front of the Baptista Supermarket. I don’t know whether I searched a little bit more around there, but not long thereafter I met Dave coming down the road in front of the Supermarket, erm, just looking terrible, just pale, erm, you know, sort of, you know, sort of fear in his eyes, saying, you know, ‘This is’, erm, ‘This is really bad. This is bad’, you know, ‘No-one’s found her. No-one’s found her’. Erm, and I don’t know what happened at this point particularly, erm, whether we went around there, but at some point or other me, Matt and Dave found ourselves either back at the flat or, or, or, together somewhere nearby and decided that we would, erm, head down to the beach,


Sylvie, who was the translator, I’m not sure when she arrived whether it was before the Police arrived or after the Police arrived or whenever, 

then when the PJ actually arrived they came and got me to go and talk to the, the PJ”.
I can’t remember what time of night that
is, but that might have been before the Police came as well or just after the Police, but
they’re the only other real people I can remember talking to”.(nannies)

Reply “Yeah, she was certainly, yeah, she was, she was English, you know, clearly not a, not a local. Erm, next it says ‘We tried to find a picture of Madeleine’, I mean, it wasn’t so much struggling to get the picture, it was struggling to find the means of printing it. We had the cam, we had Kate’s camera, erm, the, what we were trying to do is find a picture that actually gave a good likeness, rather than just being any old shot it actually had, you know, a close-up of her, of her face. There were a lot of pictures on the camera but they were, you know, just at home and on, you know, in profile and things like that”.


We were searching for a printer and Kat, one of the Nannies, said she had a printer’. I’m pretty sure it was Kat.

 Kat was there and Leanne was there, but whether it was actually their printer or lead, I’m not sure. The rest of that paragraph, erm, is fine. Erm, I think Gerry, it was actually Rachael, where it says ‘I’m not sure who informed the Authorities or media about Madeleine’s disappearance’, it says ‘It may have been Gerry’, erm, oh I beg your pardon, it’s the Authorities there, it says ‘Authorities or media’. I think, erm, Gerry and Matt, erm, were the people who, who actually tried to get the Ocean Club to phone the Police but it wasn’t the media, so maybe delete, if you delete ‘or media’, because the person on the media, I think that was, I think that was Rachael”.

I loathe the media’ comma, just to make it, just to read. Erm, ‘A very low opinion of them’, full-stop. ‘David also’, ‘David was also keen to make use of the media and I think he may have conducted’, conducted, ‘may have sent an email but I’m not sure’, I think he was looking to do it but I don’t think, erm, I don’t think that actually happened”.

When they were on their way to this place and in the Valverde area, they received a new communication, informing them that this was a very young child and that her father had called again. They continued on their way, now with urgency, heading for the main reception of the resort.

He found it notable that when they were still at the main reception, the father kneeled down, laying his head on the ground and crying, at the same time as making an expression which the witness did not understand.

After hearing about the circumstances of the disappearance (from the father with the help of translation) at a determined moment he thinks it was the father who told the translator that it was an abduction, at least this is how it was translated.

Chief of the GNR Search and Rescue Team. He coordinated all the work carried out by the two sniffer dogs in the Luz zone and the immediate areas relating to the disappearance of the English minor Madeleine McCann from the Ocean Club. 
• He remembers that on the 4th of May of the current year, around 23H00, they attempted to tentatively identify and thus reconstruct the path taken by the missing minor. They gave the dogs a Turkish bath towel which was supposedly used by the child in question. This operation was realised by two different dogs.
• That after having given the sniffer dog the towel and next to the residence of the missing girl, more specifically, next to apartment block 5A and 5, the first sniffer dog headed toward the door of that apartment. Immediately afterward, he headed in the direction of block 4, returned around block 5, and came down a road that exists between this block and the leisure area (pools, restaurants, etc). He turned right; in the direction of the aforementioned apartment and headed toward the main road. There, he crossed the street and next to the wall of block 6, turned right, and headed toward the contiguous parking area. More concretely, he headed next to a light post and sniffed the ground around that post. After this, he crossed the street again and headed toward the access zone to the restaurants and pool area, sniffing the door which was closed at that time. He again went to the parking zone, and at that point, lost the scent. 
• When carrying out this operation with the second dog, he followed the same rout, took the same direction and headed toward the light post in the parking lot mentioned above. He sniffed the area and at that point appeared to have lost the scent. The only difference was that this dog did not head toward the entrance of the restaurant or the pool area. 
• None of the dogs used in this search, after having been given the towel supposedly used by the child, entered into block 5 but went immediately to the street between the apartment and the leisure area. It should be taken into account that the second sniffer dog may have been conditioned by the first sniffer dog. That is to say that in the case of doubt, the second dog may have followed the second of the first. 
• Taking into account the aforementioned results, he states that it can be confirmed with a certain degree of certainty that the missing child passed by that location, on that day or on a previous day. This situation can be explained by the nature of the terrain, that is, it is a small space enclosed by walls and as such lingering scents would take longer to dissipate. 

Yesterday (08.05.2007) around 23H45, this search action was repeated but this time the dogs were sent into blocks 5 and 4 of the ‘Ocean Club’ resort. During this operation, and given the time that had passed combined with the heat, the results that were achieved are very relative given that the dog will confirm all the odours it scents, certainly alerting to those that are most active, namely due to the fact that the apartment was occupied. It is also noted that the dog’s perception in the interior may be affected by noise. 
• The initial diligence carried out with first sniffer dog, after having sniffed the towel used in the previous operation, began searching and showing interest in some doors leading to other apartments. He did not show any interest or even approach other apartments. In none of these actions did the dog give the signal to his trainer, Soldado Fernandes. It is certain however, that the dog signalled next to apartments 5J, 5H, and 4G. He showed great interest in sniffing these doors and the immediate areas. Next to door 5H there were two bags of rubbish and the odour may have distracted the dog. Outside 4G was a tray of plates, cutlery and cloth napkins that had apparently been used. This apartment is where the parents of the missing child were staying (at the time). Concerning apartment 5J, the same may have been conditioned by the presence of people in the interior or he could have sniffed an odour that needed to be confirmed.
• He states that after the search inside block 5, and whilst in the exterior, the sniffer dog took the same route on 04.05.07, being the existent road of that apartment and the leisure area (pools and restaurant) and then went to the same parking area. At that point, the scent was lost. This situation may be related to the fact that the biggest concentration of odours are in that area and due to the fact that odours are better preserved near walls and away from major winds. It is certain that upon reaching the main road and turning right is where the biggest concentration of odours exist. This is where the dog lost interest. 
• The second dog was taken through the same operation and also showed interest at the door of apartment 5J. This same dog jumped on his hind paws to the parapet of the veranda and raised his head as though in search of an odour. As related above, this interest could have been the result of various factors but it is certain that in this area the scent was intense. In the exterior, the sniffer dog immediately headed to the parking area next to block 6 and there apparently lost the scent. 
• I would like to clarify that a search in a bad area, where a more intense odour perceived by the sniffer dog, such as in an urban area due to the large concentration of external odours, make it possible to confuse the dog. In this situation, search activity is very difficult as is the case when some time has passed since the event in question. 
• Because he is asked, he states that in relation to this, it is difficult to evaluate precisely the work of the sniffer dog. It is clear that some conditions involved in this action augment the degree of uncertainty. The signalling of the dog may only signify that they are confirming an intense odour in a zone. On the other hand, given the interest of the dog(s) in some of the apartment doorways, this could signify nothing, but could also very well mean that the dog has caught the odour. The dog did not demonstrate to its owner that it had found the scent it was searching for. 

Witness Statement of Pedro Miguel Esteves Fernandes gnr
That he is part of the Dog Search Team. In this capacity he serves as a scientific trainer and works with two sniffer dogs. He was asked to bring his team to the Luz zone (Lagos) related to the disappearance of the minor from the Ocean Club. 
• On the 4th of May of the current year, around 22H30, he was asked to use the dogs in conjunction with a search that attempted to retrace the steps taken by the missing minor. His role was to use the dogs’ skills by allowing them to sniff a towel which had supposedly been used by the minor in question. 
• That after the dogs were given this scent from the towel and near apartment 5A of block 5, the first sniffer dog headed to the door of that apartment. Immediately afterward, he turned to block 5, using a circumvented route to block 5, and came to the road between this block and the leisure area of the resort (pools, restaurant, etc), and turned to the left, or around the referred to apartment and headed to the main road. Having reached there, he crossed the road and next to a wall of block 6, crossed the road again, turned right and headed to the parking zone of the resort. More specifically, the dog went next to the light post and began smelling that location. After searching that zone, he again crossed the road and headed toward the entrance to the pool and restaurant area, and smelled the door which was closed at that hour. He turned again to the parking zone and stopped or lost the scent at this point. 
• When he effected the same operation with the second dog, in general, this dog took the same route and headed to the light post and showed interest there and ended by losing the scent at this point. It should be stated that the one difference is that this second dog did not head toward the entrance to the restaurant and pool zone. But he does state that the dogs followed a ‘scent trail’, a signal for the animal who was working. He is certain that they were not conditioned in any direction. 
• None of the dogs used in this search action, after having smelled the towel, went into block 5 but headed to the zone which gives access to the road between the apartment and the leisure area. He states it should be noted that the second dog may have been conditioned by the original path taken by the first sniffer dog as he may have smelled the first dog’s path taken.
• Taking into account the aforementioned result, he states that it can be confirmed with a certain degree of certainty that the missing minor passed that location, on the day of the events or before that date. This situation can be explained by the configuration/layout of the area. That space is reduced and flanked by walls. This helps to conserve scents that may otherwise be affected by winds, etc. He would like to clarify that these sniffer dogs are more used to effecting this type of work in rural settings where there is not such a great concentration of odours.
• Yesterday (08/05/07) around 23H45, this search action was repeated but was centred on the dogs inside blocks 5 and 4 of the resort. He adds that in this type of operation, given the time that had lapsed, and with the heat that could already be felt, the results obtained may be highly relative given that the dog will confirm all the scents it comes across. It is certain the dog will react to more active scents, namely because the apartment is occupied. Also, any noise perceived by the dog in the apartment may make the dog loose interest. 
• Initiating the diligence, the first sniffer dog, after having smelled the towel used in the previous operation, began searching, it being certain that next to the doors of some apartment he demonstrated major interest whilst he did not even approach others. In none of these actions did the dog give him a signal that he had caught the scent of the missing child. It is certain however, that near apartment 5J, 5H and 4G, that the dog showed major interest in smelling the doors and the immediate areas. He states that next to 5H, there were two bags of rubbish which may condition the dog. Just outside apartment 4G was a tray with plates, cutlery and cloth napkins, apparently used. It is certain that this apartment is the one where the missing child’s parents were lodged (at the time). In relation to the dog’s interest at doorway 5J, the same may have been conditioned by the presence of people inside the apartment.
• After completing the search in the interior of block 5, verandas and apartment access, and whilst in the exterior, the sniffer dog took the same route he had taken on 04/05/07, being the road between that apartment and the leisure area—pool sand restaurant, and headed toward the same parking area. There he lost the scent of the search. This situation may be explained by the fact that the biggest concentration of odours in that location have been preserved and protected from the winds due to the adjoining walls. When this dog got to the main road, he turned right where a large dispersion of odours existed. Here the dog lost the scent. 
• The second dog was submitted to the same operation. He too showed interest in the door of apartment 5J. Here he got up on his hind paws to the parapet of the veranda and raised his head in such a way as to catch the odour. As mentioned previously, this interest may be due to various factors but it is certain that at this location the dog scented an intense odour. In the exterior, the sniffer-dog immediately took the first road, heading toward the parking area next to block 6, and there lost the scent. 
• He clarifies that a search in a rural area, where a scent is much more intense is immediately noted by the sniffer dog but in an urban area, the great concentration of external odours make it possible to confuse the dog, This makes searching difficult as does the time passed between the event and the search. 
• When questioned, he states that in relation to an action of this nature, it is difficult to evalauate precisely the work of the dogs, even though he is well aware what these dogs are capable of. The conditions that surrounded this search made the degree of uncertainty that much greater. The dogs may have signified or confirmed intense odours in that zone, however, they may have also merely have given a confirmation of a scent. They did not demonstrate that they had detected the odour in question.

gnr NPAfter hearing about the circumstances of the disappearance (from the father with the help of translation) he does not remember whether the word abduction was mentioned, and he went in his police car, to the apartment, accompanied by the father, the friend and the translator. When he arrived at the apartment he saw that the wooden door, now referred to as the main door, was closed and he thinks someone who he cannot identify opened it. When he entered, there were other individual apart from the mother, he does not know how many but there was at least another couple present.

Then, with his colleague, he searched the apartment. He opened all the cupboards of the bedrooms, living room and kitchen and he checked under the beds and in the fridge. He did not see the washing machine. He did not see anything strange during the search and there was no sign of a break in. As regards the bed clothes of the child’s bed, he found it to have a normal disposition.

remembers that the window in the girl’s bedroom was closed with the blind raised up the space of the width of a hand. He does not remember the existence of curtains. The father indicated, through the translator, alleging that when the disappearance was discovered, the windows and blinds were open.

He found the parents to be nervous and anxious, he did not see any tears from either of them although they produced noises identical to crying. He did not feel that this was an abduction, although this was the line indicated by the father.


jr2After hearing what had happened he went to the exact site the girl had disappeared from accompanied by his colleague, Nelson Costa, the girl’s father, a woman acting as interpreter, whose surname was Ramos, and another individual, a friend of the girl’s father, whose name he does not remember.

He never spoke directly to the father or with any other persons of foreign nationality, the questions were formulated to the interpreter who acted an intermediary in the dialogue.

He remembers that inside the apartment Madeleine had disappeared from was the mother and another foreign woman, whom he assumed to be a friend of the family

At about 23.10/23.17 he heard from a telephone call from the Patrol Commander, Officer Roque, that there had been a disappearance at the OC resort, P da L.

He was told that (Roque) had already gone to main reception of the complex in Rua Direita and had met the father of the little girl who had appeared in the reception with a friend. Together with employee Silvia (service manager of the OC and who also acted as translator, the father (Gerald McCann) and the friend they went inside the apartment from which Madeleine McCann had disappeared. After Roque checked that the child was not in the apartment, he gathered information from the mother and father. He was told by the patrol, that the father had put forward a theory saying that it could have been an abduction. He was also told that there was a shutter that had been “raised”. 

The witness, from the description and supposed seriousness of the facts related, ordered the immediate preservation of the scene, and said he would go to the site and communicate the facts to the PJ (this was done from the Post, he does not remember which officer did this but thinks it was Officer Patricio).

gnrMP- At reaching the location, the two elements that made up the patrol , the current witness and his colleague, Nelson Costas, proceeded into the interior of the apartment, with the goal of investigating the contours which eventually surrounded the disappearance of that minor; 
. In this sentiment, the deponent states that they searched al the dependencies of the residence and all the pieces of furniture, in order to confirm the disappearance -- effectively confirming that that she was not in the interior; 

gnr chiefJRJosé Maria Batista Roque- During the search he did not find anything strange apart from the bedclothes on Madeleine’s bed, which were too tidy, it appeared that she had been picked up of had left the bed with great care.

gnrADAntonio Henrique de Conceiçâo Duarte -  he arrived at the site of the disappearance of the young girl on 3rd May of this year, about 25 to 30 minutes after the patrol.

Upon arriving at the site he was told that this was a case of abduction, this information being transmitted, he thinks, by the girl’s father. He was also informed by Silvia (head of maintenance at the resort) that the parents and friends said it was an abduction, their intention being to inform the media, and that they were in fact making phone calls to this effect.

he remembers that the blinds of the window of the child’s room were open, but inclined (the lower part, at about a hand’s width). He does not remember if the window was open or what the state of the curtains was. He did not enter the room because he was told, he does not remember by whom, that the twins were sleeping.

He then went to the apartment, accompanied by his colleague, the father and friend as well as the translator. When he arrived at the apartment he saw the mother there, who opened the wooden door, now referred to as the main door. Then, while his colleague remained in the hall, and the others were in the living room, the witness went through the entire apartment. He opened all the cupboards in the bedrooms, living room and kitchen and checked under the beds and inside the washing machine. He did not see the fridge.


During the search he did not find anything strange apart from the bedclothes on Madeleine’s bed, which were too tidy, it appeared that she had been picked up from or had left the bed with great care

After the search, he noticed a situation that seemed unusual to him, when at a determined moment, the girl’s parents kneeled down on the floor of their bedroom and placed their heads on the bed, crying. He did not notice any comments or expression from them, just crying. He says that at the main reception the father also knelt down, placing his head on the floor and crying. He did not hear the father say anything.

He never heard the parents ask to see a priest.

After the search of the interior, his colleague went to check the area around the apartments and the Tapas Bar, while the witness remained next the apartment, just outside it. At that moment a female individual, he does not know whether she was a member of the group of friends, who was in the neighbouring apartment, said that she saw an individual carrying a child, running, and that because of the pyjamas she was wearing it could have been Madeleine. It was in these circumstances that abduction began to be talked about. 
This sighting did not seem to him to be very credible, because when he asked her about the physical characteristics of the individual, she said it was very dark, however she saw the pyjamas clearly.

When asked, he said that at that time he also saw a lot of local people, who were searching for the missing girl.

Whilst he was outside he talked to the witness mentioned previously and to some residents who had not seen anything. He exchanged some words with the mother, who was crying and only asked for more police officers

When questioned about the bedroom windows, he only remembers that blinds of the window of the girl’s bedroom were not totally closed. He does not remember about the existence of curtains or whether the window itself was closed.

He says that in the apartment there were two beds and two cots placed in Madeleine’s room, he does not remember their position. The children never woke up, he is sure, not knowing what position they were in, however he found this situation to be very strange, as a lot of noise was made.

As regards the parents, he says they were nervous and anxious, emotional. He adds that upon observing the scene it did not appear to him to be an abduction, but rather a normal disappearance where the child had left by her own means.

After the search he told his colleague to wait by the door while he went to the area around the apartments and the Tapas Restaurant. Whilst he was doing this he noticed the presence of many local people who were searching for the girl.

He also refers to a situation when he was searching outside, near the pool, that someone from the OC whom he cannot identify, passed him a mobile phone, as a British Consulate employee who spoke in Portuguese, wanted to talk to the authorities. Upon speaking to him, he told him that the investigation and subsequent actions were under the responsibility of the PJ.

On the patio next to the front door, was an English woman who had spoken to the patrol, and had referred to having see someone pass in the street, in a dark area, who was carrying a child. As the information had already been gathered and given his limited knowledge of English, he did not manage to talk to the woman.

gnr AD-As regards the witness who alleged to have seen an individual carrying a child, whose (the witness) name he cannot remember, he says that upon learning of this situation, she stood next to two soldiers,(GNR) awaiting the arrival of police (PJ) officers. He did not speak to her as he does not speak English well.
he did not enter the apartment, as it had already been searched, but instead remained outside. Upon arriving and finding out about the situation with his Chief Roque, he carried out a search in a GNR car of all the places the child could be, specifically in commercial establishments, swimming pools and open spaces.




GNR NFPNelson Filipe Pacheco da Costa -One of the group contacted Sky News and the Embassy that night. He does not know if the parents made the call

Amy Tierney saying that she was approached at her desk at the Tapas restaurant at about 24.00 by Russell O' Brien who asked if she could help print out photos of Madeleine. She went to fetch another printer and printed out about 20 – 30 photos which she handed to Russell. The photos came from the McCanns camera.

gnrNP -As regards the entry terms which follow, this police was handed by the Guarda Nacional Republicada (GNR), four (4) 10 x 15 photographs on “Kodak Xtralife Paper” which were given to that police force by family of the missing minor MADELEINE MCCANN on the day which the facts were reported. 

In these photographs is the image of a minor, in all ways identical to the child of British nationality referenced above, in two distinct poses (two by two). 

As mentioned previously, these were in the possession of the child’s family, which from the beginning, even though there may be an explanation, appeared unusual, as on that night there was no possibility of proceeding with a revelation of the type of paper and the format used

 Meanwhile the post commander arrived at the scene and he joined him in a vehicle and travelled around the whole resort.

On 3rd May it was his day off, however he was drinking coffee at the Lagos GNR bar. He does not know exactly what time this was but he was when he was in the bar with other colleagues that he heard about the events.

Together with his colleague, Santos, he immediately offered to do all that was necessary to help.

After having helped his previously mentioned colleague prepare a message to distribute the news, he left for the OC in his own car. He arrived with his colleague Santos between 00.00 and 00.01 and presented himself to the GNR post commander, Duarte.

He was immediately sent to one of the search zones, initially accompanied by the post commander.

He never entered the McCann apartment the girl disappeared from.

On 3rd May when he was at home, he was contacted by the GNR post commander who asked him to go to P da L.

He arrived at the OC at 00.05 on 4th May having contacted his colleague Nelson Costa who informed him about the situation.

After having been informed ha began to search the perimeter of the tourist complex. First he revised the perimeter alone and was later accompanied by Officer Pimentel. During his time on the scene he did not talk to anyone.

Neither did he enter the apartment from which Madeleine had disappeared. There many people at the scene but nobody particularly drew his attention.

When asked he said that he never saw Robert Murat in all the times he visited the scene.

He does remember however, that on a day he cannot recall, an individual who identified himself as Robert, saying that he was in P da L as a translator helping the PJ, phoned the Lagos post saying:

That some foreign women, who had already been interviewed by the police, had phoned him, telling him that there was a child crying in an apartment near to them.

At the scene, he talked directly to the patrol and to Silvia who informed him about what had been said. His hope was that the child had left the apartment alone and got lost or that someone had seen her and stayed with her temporarily.

He gave orders to the post so that they would send more officers to the scene, amongst them he remembers Officers Pimentel, Costa, Silva, Santos, Casimiro and Neto. He ordered one officer from the patrol to stay on the scene – Officer Costa. He then contacted the interim commander in Portimao, Lieutenant Bengala. He then went with Roque to several establishments that were still open and also patrolled the zone, in his car and on foot.

Between 05.30 and 06.00 he went home, returning at 08.00.

NFP - Upon leaving the apartment he saw various photographs of the little girl printed on normal A4 paper which had been printed at the reception as well as other photos printed on 10 x 15 photographic poster paper which could not have printed at the reception. This seemed unusual to him and he later confirmed that they could not have been printed at the reception.

At about 00.00 on 4th May, he received a telephone call at his home from Officer Costa, informing him that a child had disappeared from P da L. he was also informed that the post commander had previously tried to contact him, which had been impossible as he had left his home, forgetting to take his mobile phone with him.

He immediately left for P da L in his own car and met his post commander, Sergeant Duarte who accompanied him to the site of the events in the resort in P da L. Officer Costa was on site. The witness arrived at 00.10 - 00.15.

According to orders from his superior he teamed up with Officer Costa to carry out external searches of the resort in case the girl had left the apartment and got lost nearby.

he arrived on the scene about 30 – 40 minutes after the phone call from the GNR, at about 00.40/00.50.

At the scene, there were already some elements from the GNR and some people walking around the OC grounds, searching for the child.

In the apartment where the family was staying, there were different persons, including the friends of the girl’s parents, who were immediately invited to leave the apartment, in order to preserve the scene.

Inside the room that was indicated as being that of the missing girl, there were two children, babies, who appeared to sleeping in two cots placed in the middle of the room.

A request was made to the OC services director for the family to be re-allocated and accordingly the babies were taken out of the room, so that the site could be searched.


The OC services manager introduced him to the missing girl’s parents, who looked quite tired and anguished, particularly the mother who appeared more upset and was therefore less receptive to conversation, which led the witness to converse only with the girl’s father.

He was brought into service together with an Inspector from the station. It was the inspector’s duty to take notes of the services as well as all the information relating to them. The inspector who accompanied him on that date, Vitor Martins, informed him that the case in question was that of the disappearance of a small girl, of British nationality, who was staying at the OC with her parents.

The immediately left for the scene and arrived about 30 – 40 minutes later, at about 00.40/00.50.


When they arrived at the scene, which they immediately identified due to the presence of GNR officers, as well as quite a lot of people who were walking around the street searching for the child, they immediately went to the apartment in question, where they found several people, including some GNR officers, as well as the head of the Lagos GNR station.

He states that the people inside the apartment and close to it, entered and left the building and circulated in the whole apartment, completely freely, in other words, without there being any restriction or care in preserving the scene. .

He said that these people were the friends of the parents of the missing girl and a lady responsible for the resort called Silvia.

He was shown the room the child had disappeared from, having noticed that people also entered and left that room without any care in the sense of preserving traces. Inside this room there were two children, babies, sleeping in two cots placed in the middle of the room.

It was requested that the babies were moved, which was done accordingly, the witness having subsequently put his gloves on to begin the on-site inspection.

PJ VM - After the site had been isolated, he proceeded to make an inspection, together with the inspection and photographic report carried out by Deputy Specialist João Barreiras.

He states that he always maintained telephone contact with his superiors, in order to inform them of the inquiries carried out, until, at a time he cannot recall, after having completed the inquiries requested, he received orders from his superiors to return to the Portimão DIC, where the report was subsequently compiled. 

That Gerald McCann, the missing girl’s father, informed him that the children of the couple’s friends were in another apartment and that they were being looked after by the mother of one of the friends, who was never present in the apartment whilst the inquiries were being carried out.
 
Finally, he states that the photograph of the missing girl was handed to him by Gerald McCann, the girl’s father, he does not remember seeing the photo in the possession of any other person.

After the arrival of the witness and his colleague Vitor Martins the scene was isolated and the inspection began, namely the collection of statements and inspection of the scene, the respective reports that were subsequently attached to the process documents. 

The witness carried out finger print testing on the inside of the bedroom window, where the girl had been sleeping, leaving other examinations for the following day given that on that occasion these tests could not be carried out in the best technical conditions. For this reason, the apartments and the surrounding area were sealed off, watched over by the GNR officers who remained on site.

As far as he knows, after the first examination, other members from the finger print detection service and also officers from the LPC Crime Scene arrived at the scene.

The witness states that, at a given moment, the father of the missing girl led him to understand that he had already contacted the Sky News TV station and informed them of the situation.

As much the father as the girl’s mother looked quite worried with the situation and he can even confirm that the mother was very agitated and out of control, crying a lot and shouting in an uncontrolled manner, saying in English “They have taken her”.

On 4th May 2007 he entered into the service of the events occurred at 01.00, having received orders from the commander to go to P da L. He arrived at the OC complex at 01.10 and went to join Commander Duarte, who updated him on the situation and sent him to Rua da Ramalhete.
On the scene where he had been sent by the Commander, he began to revise the perimeter of the resort, in a police car accompanied by his colleague, Officer Neto.

During his time at the scene he did not have any contact with anyone. Neither did he enter the apartment Madeleine disappeared from.

They did not enter the apartment zone nor the parking area opposite - He saw many people, mainly British, who were helping with the searching.

gnr PN -At about 02.15 – 02.30 and after having helped his colleagues from the PJ who had arrived at the site, they contacted the Commander again and were told to search the area surrounding the resort.
-They were in the area until about 09.00 searching in coordination with GNR team members, at which time they were relieved by other officers who came on duty.

gnr AD-As concerns the photos of the child, he says that he only saw what he calls the originals, poster type 10 x 15 cm on photographic paper. He did not see any other type of photos. Upon being shown a sample, he recognises it as being identical.

When asked he say he does not know the quantity of photos, but that there was more than one. He says that of these photos, at least five, he annexed one to the document he sent to the Tribunal and another four were handed to the officers carrying out searches, which were later returned and handed to the police, in due course.

He says he does not know who handed him the photos, different from each other, two by two.

He is sure that he is the person who received them.

He states that the photos came from inside the apartment, he still cannot say who had them. When he was inside the police car, gathering identification documents from the parents, he asked someone nearby for photos, he does not know if that person was Portuguese or British. This same person entered the apartment and came out with the photos.

He does not know whether it was Silvia Baptista who gave him the photos, as she was translating the conversations, neither whether it was someone from the family or friends.

He is sure that he received them in the early morning, at about 02.00, when the police arrived, after having carried out the first search.

He has the impression he saw the girl’s father, however he cannot confirm whether he was the one to give him the photos.

He presumes he was given the photos directly, or in other words that they were not passed to him via someone else.

When questioned he says that the photos could not have been printed/revealed at the Ocean Club installations (they do not have this kind of paper). He adds that the photos produced the following day, which he observed, were printed on A4 paper, which was available at the resort.

At the beginning the possibility was considered that the child had left the apartment of her own will, and that she couldn’t have gone far from the scene and that she would be found wandering/lost (at this time there were already dozens of people looking for her).


However, a little more than an hour later, about 02.00/02.30, as the child had not been found, he decided to contact SEF at Faro airport with the aim of alerting them in case anyone would board accompanied by some child, whoever she was and those accompanying her should be duly identified, however the various calls made were not attended. In the face of this situation I contacted the Faro Station from the police and told them what was going on and asked them to alert the SEF.

I also decided to alert the GNR in Lagos so that they would send out a warning so that the car and foot patrols that were out on the ground would pay attention and identify cars with people out driving at that time who were accompanied by a child (children).

On 4th May he was called at about 01.15, he arrived at the OC at about 1.55, accompanied by the officer Laçao.

They presented themselves to Sergeant Duarte from the GNR Lagos post and were informed by him of the disappearance of a small girl from the resort. There were other GNR officers present at the scene, but he does not remember their names. There were also PJ officers present.

After having established exactly where the girl had disappeared from, he was given a piece of her clothing by one of his colleagues, whose name he does not remember.

From the door of the apartment, accompanied by his dog, he walked around the entire perimeter of the resort and revised the interior of several of the apartments.

As he did not obtain any results in the area close to the resort, he extended the perimeter of the search to a distance of 1 km. 

He does not remember having seen plain clothed officers at the scene.

He remembers having seen the McCann couple once, near to the door of the apartment. He did not have any dialogue with them as he does not speak English.

He says that he did not have any dialogue with anyone, limiting himself to exercising his functions, accompanied by his dog, with whom he searched.

He says that he never entered the apartment which Madeleine disappeared from, he was only in the access corridor to the apartment.

He also emphasises the situation that someone, who he cannot identify, having contacted Sky News and the Embassy that night. He does not know if were the parents.

He also notes that he saw various photographs on normal A4 paper of the girl, which had been printed at the reception, as well as other photos on photographic paper, poster type 10x15, that could not have been printed at the reception. This seemed unusual to him and he later confirmed that it was not possible for them to have been printed at the reception.

At about 02.30 after having been replaced by two colleagues, he left the scene as the police (PJ) had already arrived.

When they arrived at the scene, they entered the McCann’s apartment by the front door, and entered the living room, where there were some PJ officers as well as the MCCann couple. The just talked to some colleagues from the PJ and asked for a piece of clothing that Madeleine had worn or used recently. They were given a pink/orange blanket that the child had been covered with in her bed.

They began searching with the dogs from the main entrance to the apartment, having given the blanket to his dog Numi to smell and begin to search.

The route initially taken was from the front entrance door to the passageway between Blocks 4 and 5, along the corridor and then along the passage that leads past the entrance to the small reception to the resort’s swimming pool. After that the whole of the area surrounding the resort was searched.

With regard to the indications transmitted by his dog Numi, he says that at the beginning he was only “a little interested”, he let the dog "get on with it" .

They finished the searches at about 07.00 AM.

He only had direct contact with the couple and their friends at about 04.00 when Gerry McCann approached the GNR group of which he was a member to ask whether there was a church close by. He replied to him in English, giving the directions to a nearby church.

During the searches that he carried out on the scene until 05.00, he saw many people searching and he especially remembers two large groups of 10 – 15 people. One close to the beach and the other near to the McCann apartment block in Rua Agostinho da Silva.

He remembers that during a brief rest period at about 04.00, Madeleine’s mother asked whether there was any news and whether the roads had been blocked off.

There were some unknown people helping in the searches, especially when they arrived at the resort. Their number decreased as it got later. Between 04.00 and 07.00 basically the only people searching were the witness, his colleague and another GNR officer.

At about 04.00 AM they searched the streets, gardens, caravans, lorries, etc. As well as questioning lorry drivers in the parking area next to the “Luz Tur” building, they stopped a caravan with two English individuals, who said they lived in the Espiche area. The caravan was duly searched

When questioned, he says that it was a fresh night with some breeze. It was not a clear night, nor was it very dark. Referring to the light conditions around the apartment, he says they were very dark, and thinks that even on a bright night there would always be little light around the apartment because of the trees and lack of street lights

During the early morning in question I received some telephone calls from people whom, with the exception of one, expressed themselves in Portuguese to ask whether an English girl had really disappeared in Lagos and about what was being done with relation to this and I informed them that this was true and that inquiries were being made in order to find her. One of these calls, from the person who did not express themselves in Portuguese but in English and which was received between 04.30 and 05.30, was made by someone who identified themselves as being from the Sky News TV chain and who requested the same information mentioned earlier.

He say he does not know Murat, and does not have the notion of having seen him before Friday 4th May at the mobile post installed at Rua Agostinho da Silva.

The first he knew about the existence of Murat was of an active individual who offered his help to translate some information/contacts with people who arrived at the mobile post, also offering to make a bridge with the OC.


He remembers that on a certain day, which he cannot specify, a journalist whom he cannot identify, informed him that amongst the Portuguese and foreign journalists at the scene, suspicion was “running” about Robert Murat. Together with Officer Sequeira he informed the PJ to transmit this information.

On the following day, in the morning, he remembers that Robert Murat arrived at the mobile post saying that he noticed the journalists’s suspicion about him and gave his mobile number and told him that he was going to discuss this with the PJ and that he was going to have “dinner”.
